    Angry Stupid Chp

    alright here is the story and im going to court on this one for sure. yesterday i was hauling some bakery equipment back to my shop from mira loma to riverside on the 60 fwy. The load was a little top heavy and weighed in at about 14,800lbs so i was cruising around 58-60 well the right lane ends right at valley way and as im waiting to move over cuz im getting passed by an 18 wheeler there is a CHP behind the truck who looks over at me as hes passing me and slows down and lights me up. So im thinking its something about window tint but my drivers window is down and arm out. when he comes up to the truck he asks me if i know the speed limit while towing and i say yes 55 he asks how fast i was going and i admit to 60 then he tells me 74 and i called him a liar. so i give him my licence reg, and ins as asked and he throws the insurance card back in the truck at me and says he will be back. i got a ticket for 70 while towing, mud flaps and no insurace even though i gave him my insurace. now this is a black cop who i have no problem with as one of my good friends who is black is with me and the cop tells him that "he should not be with a young white tattooed up boy with a truck like this." so now i have to prove some how that i was not doing 70 which he wrote me up for and the insurance and mud flap thing is just a hassle but my friends pissed and said he thinks the cop had something against either my age, lifted trucks or the fact that there was a black guy associating with a white guy and i need help figuring out how to handle this in court as no judge will beleve what he said to us.

    yah man its gonna be tuff.....and he knows it too... thats the reason he did it... every time i read stuff like this it makes me wish i had a hidden camera somewhere on the truck

    Go ahead and take it to court, even though your chances of winning are slim, there is still a chance. Mention the fact that you were being passed by a big rig, etc., which may devalue the radar claim. Have your friend (witness) go to court with you to substantiate your claims.

    Definitely take the time to go down to your local CHP station and file a complaint against the CHP officer for making the racial statements and not accepting your proof of insurance. Even though he may not have said anything negative about whites or blacks, the fact that it came up as part of his conversation is enough for a complaint claim. If your buddy (witness) can go with you that's even better. You never know, this officer may have other complaints for the same thing, and it looks suspicious when complaints for the same problem keep coming up. Even if he doesn't have any complaints against him, yours will be the first and may help others down the road.

    As a suggestion, in the future if you are given a citation for something that isn't legal / right (i.e. you provided proof of insurance but the officer threw it back), do not sign the citation and request that a supervisor come out to the site. Yes, they have to send a supervisor out in that type of situation. If the officer refuses to call a supervisor, still do not sign the citation and call the local CHP / law enforcement office yourself from your cell phone and request that a supervisor be sent out to the site. It takes more time to do this, but it may save you from being written up for something unnecessarily.

    yeah i know about the field supervisor but i had a bad experiace in the past with that i got pulled over for racing when i was speeding and reving my engine to some girl but when i called the field supervisor i ended up getting my truck impounded and it cost me about 4,500 by the time i got done with court, impound and everything else i was forced to admit guilt to keep from going to jail and my car crushed, its when they where crushing them with out cause now they have been sued for that but at the time i dident have anything to stand on. And thats a good idea about the complaint it was a riverside county CHP so ill go down to the office today but my friend is not able to go until like monday or tuesday of next week so should i wait or have him go down and file the complaint when he can.

    Insurance is now linked to your registration with the DMV. If he ran your plate he should have got the status of your insurance and did not need to ask. WTF?

    Weak... This is the type of crap you show up court for and the cop knows better than to show his face. Then you win and pay nothing. He knows he was having a bad day.

    Be careful with this kind of advice!!
    Different police agencies have different policies on this.

    With the Los Angeles County Sheriff's Department (I'm retired from), there is no requirement for a supervisor. You can ask for one, but you won't get him/her! You don't sign the citation, you just get arrested and taken to the station where you will be booked and required to post bail to get released.

    i agree. most likely what will happen. just make the complaint and take it to court. if you lose it will help somewhere down the line tho. make sure to get the complaint in. thats the most important part. perhaps you should carry a camcorder in your car :)

    Good point Samuel! There is no written policy / requirement for LASD to send out a supervisor, however many Law Enforcement Officers these days (at least the ones I know (current LASD employee)) will call for one to come out in instances like this simply because of all the bogus claims that are made against LEOs. These days it's all about Covering Your A$$ (as far as the LEO is concerned) so that when a claim is brought against you, you are able to defend yourself.

    In the end the signature on the citation is simply a promise to appear in court on the date indicated, and is not an admission of guilt in any way.

    what is sad is if you were black and he was white you could sue and probably win. (I'm not meaning this in a racist way but this is what society has come to sorry if i offend any one i don't mean to) i my self have problems w/cops because of my daily driver they always think I'm up to no good i say go to court he wont show up and if he does tell the judge every thing and bring your friend as a witness good luck

    97 ford ranger w/camberg 6" beams 14"2.5 king coilovers and king 2.5 bump stops. In the rear i have a set of national prerunner leaf pac w/ 16" smooth body kings. w/19" of wheel travel in the front and 17" in the rear full cage done by me with fiberglass dash and autometer gauges


    o5 crf 450 mostly stk and a 96 banshee not even stk but blown up now lol
